On October 24, 2016, the Associated Builders and Contractors of Southeast Texas won a preliminary injunction which prevented new federal reporting requirements on contractors and subcontractors and restrictions on arbitration availability from going into effect. President Obama’s Executive Order 13673, Federal Acquisition and Department of Labor (DOL) Regulations created the new standards. Writing for the Fifth District Federal Court in Texas, Judge Marcia Crone found that the new regulations exceeded the DOL’s authority, were preempted by federal labor laws, conflicted with long-standing interpretation of the National Labor Relations Act and presented substantial threat of irreparable harm to the Plaintiffs.
